Betrifft: SPK-Verfälscher
Hier: Sie haben wieder einmal eine Niederlage erlitten
Ende 2022 wollten ein belgischer und ein Schweizer Verlag
eine französische Ausgabe von „SPK – Aus der Krankheit eine Waffe machen“ („SPK
– Faire de la Maladie une
Arme“) neu herausbringen. Sie versprachen sich davon nicht unerheblichen
Profit, gibt es doch ein großes und stetig wachsendes Interesse am
Sozialistischen Patientenkollektiv (SPK) und seiner einschnittslosen
Weiterführung in der Patientenfront (PF).
Die Herausgabe sollte stattfinden hinter unserem Rücken und
zudem ergänzt mit einem Vorwort und einem Nachwort von Feinden der
Patientenklasse. Dafür hatten sie das Vorwort von Jean-Paul Sartre weggelassen
und auch das Vorwort von Huber, WD, dem Gründer des SPK.
Nachdem sie unser Abmahn-Schreiben (s.u.)
erhalten hatten mit dem Hinweis, dass einzig und allein der KRRIM
– PF-Verlag für Krankheit zur
Herausgabe befugt und von Huber, WD, dem Gründer des SPK, exklusiv dazu autorisiert
ist, haben die beiden Verlage ihr Vorhaben aufgegeben.
Die SPK/PF(H)-Kränkschriften bleiben arztfrei
Der KRRIM – PF-Verlag für Krankheit als Rechte-Inhaber sämtlicher SPK/PF(H)-Kränkschriften bleibt im Angriff gegen Rechte-Klauer von links und rechts

Veröffentlichung von „Faire
de la maladie une arme“ (réédition)
für November 2023 an, Autor:
S.P.K. – Collectif de patients socialistes,
Vorwort von Florent Gabarron-Garcia, Nachwort von Quentin Dubois (Stand:
22.12.2022). Des Weiteren bewerben Sie die Ankündigung auf verschiedenen
Social-Media-Kanälen.
Sie verstoßen damit gegen die ausschließlichen Nutzungsrechte des
KRRIM –
PF-Verlag für Krankheit in Bezug auf die Schriften des Sozialistischen
Patientenkollektivs (SPK) und PF/SPK(H), insbesondere
„SPK
– Faire de la Maladie une Arme“.
Es ist Ihnen untersagt, eine französisch-sprachige Ausgabe von „SPK – Aus der
Krankheit eine Waffe machen“ zu veröffentlichen.
Gleichermaßen ist es Ihnen untersagt, für diese Ihre Veröffentlichung u.a. auf
Internetseiten und auf Social-Media-Kanälen (Facebook, Instagram etc.) Werbung
zu machen.
Gerichtsstand ist Mannheim, Deutschland.
Der KRRIM – PF-Verlag für Krankheit (im Weiteren KRRIM-Verlag), gegründet
1986 und autorisiert vom Gründer des SPK, Huber, WD, Dr.med., veröffentlicht die
Kränkschriften des Sozialistischen Patientenkollektivs (SPK) und der
Patientenfront (PF) ebenso wie Übersetzungen in die verbreitetsten Fremdsprachen
– von den Original-Dokumenten der ersten Tage über die von Huber (SPK/PF), WD,
Dr.med., im Knast ausgearbeiteten philosophisch-systematischen Ausführungen
sowie etliche der in den Jahren seit 1976 auf internationalen Kongressen
gehaltenen Vorträge; sowie weitere Bücher von SPK/PF(H). Es existieren
inzwischen insgesamt mehr als 50 Publikationen.
Im KRRIM-Verlag erscheint „SPK
– Aus der Krankheit eine Waffe machen“ in deutscher Sprache (6.
erweiterte Auflage 1995), in englisch („SPK – Turn Illness into a Weapon“,
1993), in spanisch („SPK – Hacer de la enfermedad un arma“, 1997),

Mit der Planung der
Veröffentlichung einer „Réédition“
von „Faire
de la Maladie une Arme“
auf der Basis der 1973 bei der Édition
Champ Libre, Paris, veröffentlichten Ausgabe verletzen Sie die Rechte des
KRRIM-Verlags.
In Wahrnehmung unserer Rechte als Verlag und Besitzer der ausschließlichen
Nutzungsrechte untersagen wir Ihnen hiermit die Veröffentlichung von „SPK –
Aus der Krankheit eine Waffe machen“, sei es in französischer Sprache, sei
es in irgendeiner anderen Sprache.
Ebenfalls ist es Ihnen untersagt, mit der Ankündigung einer solchen
Veröffentlichung Werbung zu machen – dies gilt für Ihre verlagseigenen
Internetseiten, aber auch für andere Medien, z.B. Facebook und Instagram – und
dadurch unsere Schriften in den patientenfeindlichen und krankheitsfeindlichen
Zusammenhang von Zugehörigen und Helfershelfern der Ärzteklasse wie Florent
Gabarron-Garcia und Quentin Dubois zu stellen.
Rechtlicher Hinweis, den Sie dringend beachten sollten:
Die Erstauflage von „SPK – Aus der
Krankheit eine Waffe machen“ wurde 1972 vom Trikont-Verlag, München,
herausgegeben.
Nach Aussage von Quentin Dubois, der gemäß Ihrer
Veröffentlichungs-Ankündigung zusammen mit Florent Gabarron-Garcia Ihre
„Neu-Ausgabe“ betreuen soll und für ein Nachwort dieser Ausgabe vorgesehen ist,
planen Sie, eine „Neu-Ausgabe“ der 1973 bei Édition Champ Libre, Paris,
erschienenen Ausgabe „SPK – Faire de la Maladie une Arme“ zu
veröffentlichen. Für diese Ausgabe hatte 1972/73 der Trikont-Verlag das
Copyright vergeben, es erschien nur eine einzige Auflage.
Sowohl der Trikont-Verlag als auch die Édition Champ Libre waren nicht gewillt,
die Veröffentlichung der Schriften von SPK(H) und PF/SPK(H) fortzusetzen und
Neu-Auflagen zu initiieren. Nach einem Rechterückruf wegen Nicht-Ausübung (§ 41
Urheberrechtsgesetz) gingen die ausschließlichen Nutzungsrechte einschließlich
der ausschließlichen Vervielfältigungs- und Vertriebsrechte nach der 4. Auflage
vom Trikont-Verlag abschließend und rechtsverbindlich an den KRRIM-Verlag über.
Seit der 5. Auflage 1987 erscheint „SPK –
Aus der Krankheit eine Waffe machen“
im KRRIM-Verlag.
Die
Nutzungsrechte des Trikont-Verlags sind demnach schon lange erloschen, und mit
ihnen die der Édition Champ Libre.
Auch die Übersetzer der Édition Champ Libre-Ausgabe, Guy Leverve und Luc Weibel,
sind nicht im Besitz der Nutzungs- und Verwertungsrechte von „SPK
– Aus der Krankheit eine Waffe machen“. Als Übersetzer sind sie zwar Urheber
der Übersetzung, haben aber keinerlei Rechte am Originaltext. Jede
Veröffentlichung einer Übersetzung als Bearbeitung eines Werkes ist jedoch an
die Einwilligung des Urhebers, oder, wie im Vorliegenden, an die Einwilligung
des Inhabers der ausschließlichen Nutzungsrechte gebunden, also des
KRRIM-Verlags.
Seit über 35 Jahren liegen diese Rechte beim KRRIM-Verlag.
Das heißt: Es ist einzig und allein der
KRRIM-Verlag, der über die Veröffentlichung von „SPK
– Aus der Krankheit eine Waffe machen“ entscheidet, und dies gilt
gleichermaßen für alle eventuellen Übersetzungen dieses Buchs.
Eine Wiederveröffentlichung der Éditions Champ Libre-Ausgabe bzw. -Übersetzung
ist Ihnen somit untersagt.
Seit 1995 gibt es die vom KRRIM-Verlag herausgegebene Übersetzung von „SPK –
Aus der Krankheit eine Waffe machen“ ins Französische („SPK
– Faire de la Maladie une Arme“)
und nur diese Übersetzung ist authentisch und vom Urheber des
Originaltextes autorisiert. Alle anderen Veröffentlichungen einer französischen
Ausgabe sind verboten, weil in rechtlicher Hinsicht ein Verstoß gegen die einzig
beim KRRIM-Verlag liegenden Nutzungs-, Vervielfältigungs- und Vertriebsrechte.
Jeder Versuch, sich über den Rechteinhaber hinwegzusetzen, ist, abgesehen von
den rechtlichen Konsequenzen für die Täter, darüber hinaus ein Betrugsmanöver
zum Nachteil und Schaden der Patientenklasse. Beides ist entsprechend zu
verfolgen.
Ergänzend: Weshalb überhaupt Neu-Übersetzungen von Frontpatienten? Es gab in der
Vergangenheit Übersetzungen, aber weil diese Übersetzer nie mit dem praktischen
Tun von SPK/PF(H) verbunden waren und allein schon deshalb gar nicht die
Voraussetzungen hatten und nicht in der Lage waren, die SPK/PF(H)-Inhalte
aufzufassen, haben sie die Übersetzungen verfälscht. Sie haben nur übersetzt,
was sie woanders gelesen haben und haben dabei das absolut Neue, das SPK und
Patientenfront darstellen, verfehlt, verhehlt und verfälscht, sehr zum Schaden
der Patientenklasse.
Einzig und allein im KRRIM-Verlag erscheinen die
authentischen SPK/PF(H)-Texte, die auch die SPK-Spezifika enthalten:

Ärztekrieg der strategische Hauptpunkt,
· Patientenklasse gegen Ärzteklasse,
·
Herstellung der Menschengattung, wobei
anzusetzen ist bei den
Einzelkrankheiten und in diesem Prozess aus den
Einzelkrankheiten die menschliche Gattung zu schaffen ist – aus der Krankheit
eine Waffe machen.
Es ist einzig dem KRRIM-Verlag
zu verdanken, dass die
Schriften des
SPK und der Patientenfront weiterhin für alle zugänglich sind. Der
KRRIM-Verlag, zu diesem Zweck gegründet
von Huber, WD, Dr.med., dem Gründer des SPK, und von Frontpatienten der
Patientenfront, hat die von Frontpatienten erstellte und von Huber, WD,
autorisierte Neu-Übersetzungen initiiert und veröffentlicht (siehe oben) und
vertreibt diese in Deutschland, Europa und in Übersee, weltweit.
Im Gegensatz zur authentischen und
autorisierten Neu-Auflage von „SPK –
Faire de la Maladie une Arme“ im KRRIM-Verlag 1995, die der erweiterten
6. deutschen Auflage folgt, fehlen der bei Édition Champ Libre erschienenen
Ausgabe von 1973, und somit der von Ihnen widerrechtlich angekündigten
Neuauflage, wichtige Inhalte: Es fehlt nicht nur das von
Jean-Paul Sartre, einem
der wichtigsten französischen Philosophen der Neuzeit und Unterstützer des SPK,
eigens für dieses Buch geschriebene Vorwort. Es fehlt auch, und das ist noch
schwerwiegender, das neue Vorwort von Huber, das aus der englischen Ausgabe von
1993 übernommen wurde, sowie eine Zeittafel und weitere wichtige Texte, die zur
Veröffentlichungshistorie des Buches gehören, die allesamt nur in den
authentischen und
autorisierten Buchausgaben enthalten
sind.
Es ist zudem bezeichnend, dass Sie nicht in der Lage sind, den Namen
„Sozialistisches Patientenkollektiv“ richtig zu übersetzen. Das allein zeigt
bereits, wie weit weg Sie von jeglichem Verständnis für die Sache sind und wie
sehr die Gefahr droht, dass Sie die Inhalte des SPK und der Patientenfront noch
mehr verfälschen. Statt „Collectif Socialiste de Patients“ schreiben Sie in
Ihrem Ankündigungstext „Collectif de patients socialistes“. Wenn Sie meinen, das
sei doch nur ein kleiner Fehler, dann seien Sie daran erinnert, dass im
Klassenkampf kleinste Fehler Leben kosten können. Das Leben der Patienten in
diesem Fall, die Ihnen scheinbar nicht wichtig genug sind, der Sache Ihre volle
Aufmerksamkeit zu schenken.
Ebenso wird von Ihnen in Ihrem Ankündigungstext die Kontinuität des SPK, das nie
aufgehört hat zu existieren und das es bis heute gibt, verschwiegen, die
SPK-Kontinuität in der Patientenfront als SPK/PF(H), ebenso wie Sie die
weltweite Ausbreitung des SPK verschweigen, die SPK-Kollektive in Spanien,
Italien, Griechenland, Kolumbien, Brasilien, Kanada und in mehreren anderen
Ländern.
Um das SPK, um die
Patientenklasse, geht es Ihren Verlagen also nicht, sondern ausschliesslich
darum, mit dem SPK und seiner Agitationsschrift Profit zu machen.
Hätte zum Beispiel die Éditions Météores das SPK und die
Patientenfront in ihrem pro-Krankheit- Kampf gegen die alles
durchherrschende Ärzteklasse sowie
den KRRIM-Verlag unterstützen wollen, so hätte die Librairie Météores, die
Schwester-Buchhandlung, aus der die Éditions Météores hervorgegangen ist, z.B.
Schriften beim KRRIM-Verlag bestellen und diese vertreiben können.
Stattdessen versuchen Sie, sich über die Nutzungsrechte des KRRIM-Verlags
widerrechtlich hinwegzusetzen. Aber es war und ist eine der wichtigsten
Errungenschaften des SPK, die herrschende Rechtlosigkeit der Patienten
pathopraktisch überwunden zu haben und weiterhin zu überwinden (vgl. „SPK –
Aus der Krankheit eine Waffe machen“, Kapitel III, Historischer Teil, „Die
herrschende Rechtlosigkeit der Patienten“) und der Ärzteklasse und ihren
Helfershelfern auch auf dem juristischen Gebiet die Hände zu binden.
Wir
wiederholen: Dies ist eine Abmahnung vor Klage-Erhebung.
Als im rechtlichen Sinne besonders schwerwiegend und rechtsverletzend ist die
Tatsache, dass die in der Ankündigung für Vorwort und Nachwort genannten Autoren
Florent Gabarron-Garcia und Quentin Dubois darüber
in Kenntnis sind, dass nur der
KRRIM-Verlag im Besitz sämtlicher alleinigen Nutzungsrechte von „SPK – Aus
der Krankheit eine Waffe machen“ ist, hier insbesondere der französischen
Ausgabe.
Die Vorbezeichneten hatten sich in der Vergangenheit an den
KRRIM-Verlag gewandt: Florent Gabarron-Garcia hatte uns bereits 2016 per E-Mail
angeschrieben, um von uns das Buch in der, wie er selber schrieb: „traduction
autorisée“,
zu erhalten, und Quentin Dubois hat im Februar 2022 ein französisches Exemplar
„SPK
– Faire de la Maladie une Arme“
beim KRRIM-Verlag bestellt. Im Impressum des an ihn gelieferten Buches steht: „©
tous droits (authenticité, édition, fondation) Huber, SPK/PF(H), WD, Dr.med“.
Ihre Absicht, selbst eine französisch-sprachige Ausgabe herauszugeben
und/oder zu initiieren, haben die beiden uns gegenüber – sie wussten und wissen
um die rechtlichen Implikationen – verschwiegen.
Auf der Facebook-Seite von Éditions Météores kündigen Sie das Buch an und
veröffentlichen dazu ein Foto, das die erste Seite eines Artikels von Quentin
Dubois über das SPK zeigt. In einer Fußnote des Artikels wird die
Internetadresse des SPK genannt, www.spkpfh.de. Das heißt, dass Ihnen nicht nur
die Kontinuität des SPK bekannt ist, sondern damit auch die Internetadresse,
über die der KRRIM-Verlag die Schriften des SPK vertreibt. Damit wissen Sie,
dass einzig und allein der KRRIM-Verlag im Besitz der entsprechenden
Nutzungsrechte ist.
Statt die mindeste verlegerische und rechtliche
Sorgfalt walten zu lassen und mit dem KRRIM-Verlag Kontakt aufzunehmen,
ignorieren Sie mit voller Absicht jedwede politischen, geschäftlichen und vor
allen Dingen rechtlichen Gepflogenheiten. Auf Unwissenheit können Sie sich nicht
herausreden, haben Sie doch bereits einige Bücher veröffentlicht und sind als
Buchhändler vom Fach. Sie wissen also über die rechtlichen Implikationen eines
Verstoßes gegen die Nutzungs-, Vervielfältigungs- und Vertriebsrechte, im
vorliegenden Fall derjenigen des KRRIM-Verlags, hinreichend Bescheid. Hier
handelt es sich um Vorsatz.
Es geht bei dem Ganzen jedoch nicht nur um die widerrechtliche Verletzung der
Nutzungsrechte durch Ihre Verlage, sondern auch darum, dass sich Ihre Verlage
dadurch in den Dienst der alles durchherrschenden Ärzteklasse und ihrer
Helfershelfer stellen, hier in Person der Herren Florent Gabarron-Garcia und
Quentin Dubois, und damit gegen Krankheit und gegen die Patientenklasse. Anstatt
dass Ihre Verlage der Stimme der Krankheit und der Patientenklasse Gehör
verschaffen, lassen Ihre Verlage Krankheitsfeinde und Vertreter der Ärzteklasse
zu Wort kommen, und stützen damit ihr Interpretationsmonopol darüber, was
Krankheit ärzteklassisch angeblich sein solle. Ihre Verlage reihen sich damit
ein in die untertänige Ärztehörigkeit der bürgerlichen und sog.
nicht-bürgerlichen Verlage.
Die zur Ärzteklasse und ihren Helfershelfern gehörigen Autoren des geplanten
Vor- und Nachworts, Florent Gabarron-Garcia und Quentin Dubois, übernehmen im
Ankündigungstext scheinbar unseren Befund, dass „die
Funktion des Gesundheitswesens ... die Aufrechterhaltung und Erhöhung der
Ausbeutbarkeit der Ware Arbeitskraft“ ist (aus: „SPK – Aus der Krankheit eine
Waffe machen“, Kapitel 23. Identität von Krankheit und Kapital), – nur
scheinbar, weil sie unseren Befund nicht nur verwässern, sondern
(psychoanalytisch) verharmlosen und dahingehend uminterpretieren, dass die
„‘Ideologie der Gesundheit’ zur Möglichkeitsbedingung der Produktion“ gehöre.
Was hat dieses verharmlosende Geschwafel zu tun mit den
Aussagen des SPK, dass die
kapitalistische Produktion identisch ist mit Destruktion von Leben,
kapitalistische Akkumulation und
Massenmord also identisch sind?
Aus der Identität von Krankheit und Kapital folgt der Klassenkampf der Kranken
gegen das herrschende System des Iatrokapitalismus und gegen den Arzt. Letzterer
ist vorrangig anzugreifen, um die krankmachenden und ärztlich-therapeutisch
aufrechterhaltenen mörderischen Verhältnisse zu beseitigen. Es geht um
Patientenklasse gegen Ärzteklasse, letztere im vorliegenden Zusammenhang
vertreten in Person von Florent Gabarron-Garcia und seiner Funktion in diesem
Unterdrückungszusammenhang.
Durch diese auf Verwirrung abzielende, verharmlosende und unverbindliche
Wiedergabe der Befunde des SPK versuchen die genannten Herrschaften sich der
Verpflichtung zu entheben, unsere Befunde mit ihrer eigenen Tätigkeit, speziell
im Fall Florent Gabarron-Garcia, als Psychoanalytiker und Psychologe, auch nur
ansatzweise in Verbindung zu bringen: kann doch Gabarron-Garcia durch solche
Umdeutungen weiterhin als Universitätsprofessor, Psychologe und Psychoanalytiker
für personellen Nachwuchs für eben dieses Gesundheitswesen sorgen, ohne sich für
den Widerspruch zwischen seinem Sagen und seinem Tun rechtfertigen und
verantworten zu müssen.
Seit mehr als 60 Jahren distanzieren wir uns im SPK in kollektiver Pathopraktik
durch einen klaren Trennungsstrich von der Ärzteklasse und der
ärztlich-therapeutischen Praxis in jeder Form.
Durch unsere so tätige wie bewusste Negation bleibt der Ärzteklasse der
Nährboden entzogen. Externalisiert, sah sich die ärztliche Praxis gezwungen,
sich z.B. in den 1970er Jahren im Medium von Gefängnis und Gefängniskrankenhaus
abbilden und dingfest machen zu lassen. Im vorliegenden Fall sieht sich die
ärztliche Praxis gezwungen, sich im Medium der ärzteklassischen Verlagspolitik
von Éditions Météores und Éditions Entremonde abzubilden und sich in ihrer
Doppelzüngigkeit zu erkennen zu geben.
Auch wenn Gabarron-Garcia und Dubois so tun, als ob sie durch ihre Konstatierung
der im SPK getätigten „radikalen Kritik … der Arzt-Patient-Beziehung“ (siehe
Ankündigungstext der Éditions Météores) einen Grundzug des SPK erfasst hätten,
dokumentieren sie zusammen mit den Verlagsbetreibern, dass sie auf keinen Fall
bereit sind, den Arzt in sich abzuschaffen, geschweige denn sich selber als
Psychologe und Psychoanalytiker.
Florent Gabarron-Garcia und Quentin Dubois versuchen zusammen mit den Verlagen
Édition Météores und Édition Entremonde,
das SPK laut Ankündigungstext als Erfinder „einer neuen libidinösen Ökonomie“ zu
verkaufen. Sie versuchen, uns dadurch mit einer Signifikanten-Kette zu fesseln,
an deren Anfang und Ende die tödliche Wertgewalt der ärztlichen Norm steht.
Mit dem Waren-Etikett einer „neuen libidinösen Ökonomie“, ein Terminus
Freud’schen Ursprungs, verschweigen sie, dass es auch bei dieser „Ökonomie“, wie
bei der iatrokapitalistischen Warenmechanik, ausschließlich um Gewinn geht,
genauer gesagt: um Lust-Gewinn, um Austauschbarkeit, um Quantifizierung, also um
Zahlen und Überzählige. Trotz der von Gabarron-Garcia nur behaupteten
Hintanstellung des bloß persönlichen Lust-Gewinns des Einzelnen, geht es bei
Gabarron-Garcia um den altbekannten und den durch ein Überangebot von Waren
reichlich bedienten hedonistischen Utilitarismus, – eine Heilsgewalt
(Iatrarchie), die bereit ist, ihren Würgegriff gegen alles Kranke und Störende
immer enger zu machen und jederzeit aus der Latenz des ärztlichen Mordmonopols
in die Virulenz der Massenvernichtung umzuschlagen. Zum Wohl der Gesundheit,
versteht sich!
Mit dem Klassenkampf der Patientenklasse und der Selbstbrandmarkung pro
Krankheit haben diese Herrschaften absolut nichts zu tun. Sie sind Außenstehende
und, als solche ohne wirklichen Einblick in das, was SPK und Patientenfront sind
und machen. Alles, was sie mitzuteilen haben, ist das, was sie durch ihre
ärztlich bestimmte Psychiatrie-Psychoanalyse-Brille wahrnehmen können.
Sie
versuchen das SPK in die psychoanalytische Historie hineinzupressen, wo sie
selber sich aufhalten in ihrer Entfremdung, wo aber das SPK nie war und
auch nie sein wird. Wir
haben unsere eigene Geschichte, um darin zu leben und zu kämpfen.
Für diese akademischen Schreiberlinge der Ärzteklasse ist eine Welt jenseits der
Psychoanalyse und Psychiatrie und, damit einhergehend, jenseits jeder ärztlichen
Bestimmung, weder vorstellbar noch mit ihren persönlichen Zwecken und ihren
Klasseninteressen vereinbar.
Die klare Ablehnung der Psychoanalyse durch das SPK
ist für jeden offensichtlich, der „SPK – Aus der Krankheit eine Waffe machen“
gelesen hat. Zum Beispiel:
„Alle nach dem herkömmlichen psychoanalytischen Interpretationsschema in der
agitatorischen Situation zwischen Einzelagitationspartnern und innerhalb der
Gruppenagitationen manifest werdenden Beziehungen wie Übertragung,
Gegenübertragung, Projektionen, Widerstand etc., etc. wurden ebenso wie
sogenannte Autoritätskonflikte nach den Kategorien von Gebrauchswert und
Tauschwert aufgelöst, begriffen und im Prozess von Emanzipation, Kooperation
und Solidarität aufgehoben.“ („SPK – Aus der Krankheit eine Waffe machen“,
Anmerkung 33)
„Die Grundlage der Bearbeitung der Schwierigkeiten der Einzelnen war nicht
der Deutungshintergrund herkömmlicher psychiatrisch-psychoanalytischer
Bezugssysteme (als absolut gesetzte gesellschaftliche Verhältnisse –
Familie, Arbeitsbedingungen etc.), sondern die durch das Kollektiv
verwirklichten und zu verwirklichenden Veränderungen.“ (S. 41)
Zur Ablehnung der Psychoanalyse wird Huber 1993 in einem Interview
folgendermaßen zitiert:
„Ja, Du hast ja schon gesagt, dass Du die ganze Psychoanalyse mit Deutung,
Traumdeutung herauskatapultiert hattest und das mit dem Ödipus und der
Selbstdestruktion dann ja wohl auch.“ („Über das Anfangen“, S. 103)
Das SPK hat für seinen Teil die Psychoanalyse abgeschafft. Die Tatsachen zu
verdrehen und das SPK mit Psychoanalyse in Verbindung zu bringen, ist ein
Versuch von Gabarron-Garcia und Dubois, das SPK zu verfälschen, es in den Käfig
der Psychoanalyse einzusperren und es mit ihren Klassen-Interessen kompatibel zu
machen.
Im wohlverstandenen ärztlich-psychiatrischen-psychoanalytischen Klasseninteresse
unterschlagen sie dabei, dass im SPK der Arzt, Top-Signifikant aller
Unterdrückung, abgeschafft war und bis heute abgeschafft ist und damit auch die
Psychoanalyse. Und sie unterschlagen noch viel mehr: so auch die Tatsache der
arztfreien Kollektivierung der Krankheit im SPK. Alles was sie zu bieten
haben, ist: ein SPK ohne SPK.
Im SPK ist und war die Krankheit eines jeden Einzelnen die Krankheit aller.
Diese Entscheidung, uns die „eigene“ Krankheit kollektiv anzueignen, steht
in diametralem Gegensatz zu den Eigentumsinteressen der Ärzteklasse und ihrer
patientenfeindlich tätigen Vertreter, wie im vorliegenden Fall.
Indem sich die Verlage Édition Météores und Édition Entremonde absichtlich und
widerrechtlich auf die Ausgabe der Édition Champ Libre aus dem Jahr 1973
stützen, reproduzieren sie die Fehler und Verdrehungen der damaligen
Übersetzung. Durch die dadurch wieder in Umlauf gebrachten Verfälschungen
versperren sie für andere den Zugang zu den authentischen Inhalten unserer
Agitationsschrift und dem revolutionär Neuen des SPK und der Patientenfront.
Durch das Weglassen des Vorworts von Jean-Paul Sartre unterschlagen Sie und vor
allem Ihre Vor- und Nachwort-Schreiber, dass Sartre das SPK nicht nur zum
Weitermachen aufgerufen hat, sondern ihm darüber hinaus in seinem Vorwort in
klaren und unmissverständlichen Worten eine gleichermaßen revolutionäre
Überlieferung und eine moderne philosophische Stringenz (Signifikant/Signifikat)
zuerkannt hat.
Es sind also nicht nur rechtliche, sondern ebenfalls inhaltliche und politische
Gründe, die eine Neu-Auflage der bei Édition Champ Libre erschienenen Schrift
verbieten, auch und vor allem im Interesse der Patientenklasse
–
und insbesondere auch deshalb, weil die Verlage Éditions Météores und Édition
Entremonde sich derart ignorant zeigen, sich von solchen patientenfeindlichen
Autoren wie Florent Gabarron-Garcia und Quentin Dubois das Vor- und Nachwort
schreiben zu lassen.
Dies sind Autoren, die aufgrund ihrer berufsbedingten
Krankheitsfeindlichkeit, ihres Klasseninteresses, die SPK-Inhalte ausschließlich
durch ihre ärztlich bestimmte Psychiatrie-Psychoanalyse-Brille wahrnehmen und
das SPK damit verfälschen – zum Nachteil und zum Schaden der Patientenklasse.
Dem muss entgegengetreten werden.
Wir fordern Sie daher zu Folgendem auf:
Unterlassung der Veröffentlichung einer französisch-sprachigen Ausgabe von
„SPK – Aus der Krankheit eine Waffe machen“.
Um die Sache in rechtlicher
Hinsicht gütlich zu beenden, erwarten wir Ihrerseits die Abgabe einer
entsprechenden Unterlassungserklärung.
Löschung der Ankündigung der Veröffentlichung auf Ihrer Internetseite sowie
aller sonstigen Werbemaßnahmen.

In doing so you infringe on the exclusive rights of use of the publishing house
KRRIM – PF-Verlag für Krankheit (KRRIM – PF-Publisher pro Illness)
in relation to the writings of the Socialist Patients’ Collective (SPK) and
PF/SPK(H), in particular “SPK – Faire de la Maladie une Arme”.
You are prohibited from publishing a French-language edition of
“SPK –
Aus der Krankheit eine Waffe machen”.
Similarly, you are prohibited from advertising this publication of yours on
websites and social media channels (Facebook, Instagram, etc.), among others.

In exercise of our rights as publishers and holder of the
exclusive rights of use, we
hereby prohibit you from publishing “SPK – Aus der Krankheit eine Waffe
machen”, whether in French or in any other language.
Likewise, you are prohibited from advertising with the announcement of such a
publication – this applies to your own publisher’s websites, but also to other
media, e.g. Facebook and Instagram – and thereby placing our writings in the
patients-hostile and illness-hostile context of affiliates and accomplices of
the medical doctors’ class such as Florent Gabarron-Garcia and Quentin Dubois.
Legal notice that you should urgently observe:
The first edition of “SPK – Aus der
Krankheit eine Waffe machen” was published in 1972 by Trikont-Verlag,
Munich.
According to Quentin Dubois, who, according to your publication
announcement, is to supervise your “new edition” together with Florent
Gabarron-Garcia and is intended to write a postface for this edition, you are
planning to publish a “new edition” of the edition “Faire de la Maladie une
Arme” published in 1973 by Édition Champ Libre, Paris. For this edition the
Trikont publishing house had granted the copyright in 1972/73, only one edition
was published.
Both Trikont-Verlag and Édition Champ Libre were unwilling to continue
publishing the writings of SPK(H) and PF/SPK(H) and to initiate new editions.
After a revocation of rights for non-exercise (Rechterückruf wegen
Nicht-Ausübung, § 41 Urheberrechtsgesetz, German Act on Copyright and Related
Rights), the exclusive rights of use, including the exclusive rights of
reproduction and distribution, were finally and legally transferred from the
Trikont publishing house to the KRRIM publishing house after the 4th edition.
Since the 5th edition in 1987, “SPK – Aus
der Krankheit eine Waffe machen”
has been published by KRRIM.
The rights of use of Trikont Verlag have therefore long since expired,
and with them those of Édition Champ Libre.
The translators of the Édition Champ Libre edition, Guy Leverve and Luc Weibel,
are also not in possession of the rights of use and exploitation of “SPK – Aus der Krankheit eine Waffe machen”. Any publication of a
translation as an adaptation of a work is subject to the consent of the author,
or, as in the present case, to the consent of the holder of the exclusive rights
of use, i.e. the KRRIM publishing house.
For over 35 years, these rights
have been held by KRRIM. This means: It
is solely the KRRIM publishing house that decides on the publication of “SPK
– Aus der Krankheit eine Waffe machen”, and this applies equally to any
translations of this book.
You are therefore prohibited from republishing the Éditions Champ Libre
edition or translation.
The translation of “SPK – Aus der Krankheit eine Waffe machen” into
French (“SPK
– Faire de la Maladie une Arme”)
published by KRRIM has
been available since 1995 and only this translation is authentic and
authorised by the author of the original text. All other publications of a
French edition are forbidden, because in legal terms it is a violation of the
rights of use, reproduction and distribution that lie solely with the KRRIM
publishing house.
Any attempt to override the rights holder, apart from the legal consequences for
the perpetrators, is furthermore a fraudulent manoeuvre to the detriment and
harm of the patients’ class. Both are to be prosecuted accordingly.
Supplementary: Why new translations by front patients at all? There have been
translations in the past, but because these translators were never connected
with the practical work of SPK/PF(H) and for that reason alone did not have the
prerequisites and were not able to understand the SPK/PF(H) contents, they
falsified the translations. They have only translated what they have read
elsewhere and in doing so have missed, concealed and falsified
the absolute
novelty that SPK and Patients’ Front represent, much to the detriment of the
patients’ class.
Only the KRRIM
publishing house publishes the authentic SPK/PF(H) texts, which also contain the
SPK specifics:

Pro-illness being the principle,
·
warfare against the medical doctors is the strategic main point,
· Patients’ class against medical doctors’ class,
·
Production of the human species,
starting with the single illnesses and in this process creating the human
species from the single illnesses – turning illness into a weapon.
It is solely thanks to KRRIM
that the writings of the SPK and the
Patients’ Front continue to be available to all. The KRRIM Publishing
House, founded for this purpose by
Huber, WD, Dr.med., founder of the SPK, and by front patients of the Patients’
Front, has initiated and published the new translations prepared by front
patients and authorised by Huber, WD (see above) and distributes them in
Germany, Europe and overseas, worldwide.
In contrast to the authentic and
authorised new edition of “SPK – Faire de
la Maladie une Arme” published by KRRIM in 1995, which follows the
expanded 6th German edition, the 1973 edition published by Édition Champ Libre,
and thus the new edition illegally announced by you, is missing important
contents: Not only is the preface written especially for this book by Jean-Paul
Sartre, one of the most important French philosophers of modern times and a
supporter of the SPK, missing. Also missing, and more seriously, is the new
preface by Huber, taken from the 1993 English edition, as well as a
chronological table and other important texts belonging to the publication
history of the book, all of which are only included in the
authentic and
authorised book editions.
It is also significant
that you are not able to translate the name „Sozialistisches Patientenkollektiv“
(“Socialist Patients’ Collective”) correctly. This alone shows how far away you
are from any understanding of the matter and how very real the danger is that
you are distorting the contents of the SPK and the Patients’ Front even more.
Instead of “Collectif Socialiste de Patients” you write “Collectif de patients
socialistes” in your announcement text. If you think that this is only a small
mistake, then be reminded that in the class struggle the smallest mistakes can
cost lives. The lives of the patients in this case, who apparently are not
important enough for you to give the matter your full attention.
Likewise, in your announcement text, you conceal the continuity of the SPK,
which has never ceased to exist and which still exists today, the SPK continuity
in the Patients’ Front as SPK/PF(H), just as you conceal the worldwide
propagation of the SPK, the SPK collectives in Spain, Italy, Greece, Colombia,
Brazil, Canada and in several other countries.
So, it is not about
the SPK, the patients’ class, for you as publishers. You are exclusively
concerned with making a profit with the SPK and its agitational writing.
If, for example, Éditions Météores had wanted to support
the SPK and the
Patients’ Front as well as the KRRIM publishing house in their pro-illness
struggle against the all dominating medical doctors’ class, Librairie Météores,
the sister bookshop from which Éditions Météores emerged, could have ordered
writings from KRRIM, for example, and distributed them.
Instead, you are trying to illegally override the KRRIM publisher's
rights of use. But it was and is one of the most important achievements of the
SPK to have overcome and to continue to overcome the prevailing lawlessness of
patients pathopractically (cf. “SPK – Turn Illness into a Weapon”,
Chapter III, Development of the SPK-history, “The dominating illegality, the
lack of rights and the patients”) and to tie the hands of the medical doctors’
class and their accomplices also in the juridical field.
We repeat: this
is a cease-and-desist warning before initiating legal proceedings.
As particularly serious and infringing in the legal sense is the fact that the
authors Florent Gabarron-Garcia and Quentin Dubois, named in the announcement
for the preface and postface, are aware
that only the KRRIM publishing house is in possession of all exclusive rights of
use of “SPK – Aus der Krankheit eine Waffe machen”, here in particular
the French edition.
The aforementioned had contacted KRRIM in the past:
Florent Gabarron-Garcia had already written to us by email in 2016 to get the –
as he himself wrote – “traduction autorisée”
of the book, and Quentin Dubois ordered a French copy of “SPK –
Faire de la Maladie une Arme”
from KRRIM in February 2022. The imprint of the
book delivered to him says: “© tous droits (authenticité, édition, fondation)
Huber, SPK/PF(H), WD, Dr.med”.
Their intention to publish and/or initiate a French-language edition themselves
was concealed from us by the two – they knew and know about the legal
implications.
On the Facebook page of Éditions Météores you announce the book and publish a
photo showing the first page of an article by Quentin Dubois about the SPK. In a
footnote of the article, you mention the internet address of the SPK,
www.spkpfh.de. This means that you are not only aware of the continuity of the
SPK, but thus also of the internet address through which the KRRIM publishing
house distributes the writings of the Socialist Patients’ Collective. This
means that you know that only the KRRIM
publishing house
is in possession of the corresponding rights of use.
Instead of
exercising the minimum publishing and legal care and contacting KRRIM, you are
deliberately ignoring all political, business and, above all, legal customs. You
cannot plead ignorance, as you have already published several books and are a
professional bookseller. You therefore know enough about the legal implications
of an infringement of the rights of use, reproduction and distribution, in this
case those of the KRRIM publishing house. This is a case of intent.
However, the whole thing is not only about the unlawful violation of the rights
of use by your publishing houses, but also about the fact that your publishing
houses thereby place themselves in the service of the all dominating medical
doctors’ class and its accomplices, in this case in the person of Florent
Gabarron-Garcia and Quentin Dubois, and thus against illness and against the
patients’ class. Instead of making the voice of illness and the patients’ class
heard, your publishing houses allow enemies of illness and representatives of
the medical doctors’ class to have their say, thereby supporting their monopoly
on interpretation of what illness is supposed to be in medical class terms. Your
publishing houses thus join the subservient medical bondage and obedience of the
bourgeois and so-called non-bourgeois publishing houses.
The authors of the planned preface and postface,
Florent Gabarron-Garcia and Quentin Dubois, who belong to the medical doctors’
class and their accomplices, seemingly adopt our finding in the
announcement text that “the function of the health care system is to maintain
the possibility to exploit the commodity labour force and to increase its
exploitability” (from: “SPK – Turn illness into a weapon”, chapter 23.
Identity of illness and capitalism), – only
seemingly, because they not only dilute our finding, but also
(psychoanalytically) trivialise it and reinterpret it as if an “ideology of
health” was part of “the condition of possibility of production”.
What does this trivialising
gibberish have to do with the SPK’s statements that capitalist production is
identical with destruction of life, that
capitalist accumulation and mass murder
are therefore identical?
From the identity of illness and capital follows the
class war of the sick and ill against the ruling system of iatrocapitalism and
against the medical doctor, the physician. The latter is primarily to be
attacked and offended in order to eliminate the illness-causing and
medically-therapeutically maintained murderous conditions. It is about patients’
class against the medical doctors’ class, the latter represented in the present
context in the person of Florent Gabarron-Garcia and his function in this
context of oppression.
Through this deliberately
confusing, trivialising and non-committal rendition of the SPK’s findings, the
aforementioned gentlemen try to relieve themselves of the obligation to even
rudimentarily connect our findings with their own activity, especially in the
case of Florent Gabarron-Garcia as a psychoanalyst and psychologist:
Gabarron-Garcia can, through such reinterpretations, continue as a university
professor, psychologist and psychoanalyst to provide new personnel for this very
health system without having to justify and answer for the contradiction between
what he says and what he does.
For more than 60 years, we in the Socialist Patients’ Collective have distanced
ourselves in collective pathopractics by a clear line of separation from the
medical doctors’ class and medical-therapeutic practice in any form. Through our active and
conscious negation, the breeding ground of the medical class remains withdrawn.
Externalised, in the 1970s for example, medical practice found itself forced to
be represented and captured in the medium of prison and prison hospital. In the
present case, medical practice is forced to represent itself in the medium of
the medical-class publishing policy of Éditions Météores and Éditions Entremonde
and to reveal itself in its duplicity.
Even if Gabarron-Garcia and Dubois pretend to have grasped a basic feature of
the SPK by stating the “radical critique ... of the doctor-patient relationship”
carried out in the SPK (see announcement text of Éditions Météores), they
document, together with the publishers, that they are in no way willing to
abolish the doctor in themselves, let alone themselves as psychologists and
psychoanalysts.
According to the announcement text Florent Gabarron-Garcia and Quentin Dubois,
together with the publishers Édition Météores and Édition Entremonde, try to
sell the SPK as the inventor of “a new libidinous economy”. In doing so, they
try to tie us up with a signifying chain, at the beginning and end of which is
the medical norm’s deadly violence of value.
With the commodity label of a
“new libidinous economy”, a term of Freudian origin, they conceal the fact that
this “economy”, like the iatrocapitalist commodity-mechanics, is also
exclusively about profit and gain, or more precisely: about pleasure gain, about
exchangeability, about quantification, therefore about numbers and
supernumeraries. Despite the fact that Gabarron-Garcia only claims to put aside
the merely personal pleasure gain of the individual, for Gabarron-Garcia it is
all about the old familiar hedonistic utilitarianism, abundantly served by an
oversupply of commodities, – a violence of heal (“Heilsgewalt”, Iatrarchy) that
is ready to tighten its stranglehold against all that is ill and disruptive, and
at any time is ready to switch from the latency of the medical monopoly on
murder to the virulence of mass annihilation. For the good of health, of course!
These gentlemen have absolutely nothing to do with the class war of the
patients’ class and the self-stigmatisation pro illness. They are outsiders and,
as such, with no real insight into what SPK and Patients’ Front are and do. All
they have to say is what they can perceive through their doctor-determined
psychiatry-psychoanalysis-glasses.
They try to press the SPK into
psychoanalytic history where they themselves are in their
alienation, but where the SPK never was and never will be.
We have our own
history to live and fight in.
For these academic pen pushers of the
medical class, a world beyond psychoanalysis and psychiatry and, by extension,
beyond any medical determination, is neither conceivable nor compatible with
their personal purposes and their class interests.
The SPK’s clear rejection of psychoanalysis
is obvious to anyone who has read “SPK – Turn Illness into a Weapon”.
For example:
“In particular all those relations which have to do with the psychoanalytic way
of interpretation, relations as so-called transfer, retrotransfer, projections,
inhibition etc. and so-called authority conflicts, if they became manifest
during the course of the agitations between two persons or in the group
agitation, were taken up, comprehended and resolved by applying the
categories of utility value and exchange value and finally completely
abolished in the process of emancipation, cooperation and solidarity.”
(“SPK
– Turn Illness into a Weapon”, note 33)
“But what served as the basic background of interpretation for all the
difficulties of the single person was in no means a scheme of the traditional
psychiatric-psycho-analytic coordinating system which represents nothing
more than some social factors such as family, working conditions and so on,
about which everybody at first glance seems to be convinced that they must be
taken for absolute factors, valid in all eternity, but, quite on the contrary,
what in our work had to serve as an interpretative framework was nothing but the
real changes that the collective had already achieved and the changes that were
to be achieved further on.” (p. 56)
On the rejection of psychoanalysis, Huber is cited as follows in a 1993
interview:
“Yes, you already said that you had catapulted out the whole psychoanalysis
with interpretation and dream interpretation, and that with Oedipus and
self-destruction, too.” („Über das Anfangen“, “On the Beginning”,
p. 103)
For its part, the SPK has abolished psychoanalysis. To distort the facts and
associate the SPK with psychoanalysis is an attempt by Gabarron-Garcia and
Dubois to falsify the SPK, to confine it in the cage of psychoanalysis and to
make it compatible with their class interests.
In the well-understood
medical-psychiatric-psychoanalytic class interest, they thereby suppress that in
the SPK the medical doctor, top signifier of all oppression, was abolished and
is abolished to this day, and with it also psychoanalysis. And they are also
withholding much more: such as the fact of the doctor-free collectivisation of
illness in the SPK. All they have to offer is: an SPK without an SPK.
In the SPK, the illness of each
single one is and was the illness of all. This decision to collectively
appropriate our “own” illness is diametrically opposed to the property
interests of the medical doctors’ class and their patients-hostile
representatives, as in the present case.
By deliberately and illegally relying on the 1973 edition of Édition Champ
Libre, the publishers Édition Météores and Édition Entremonde reproduce the
errors and distortions of the translation of that time. By recirculating these
falsifications again, they are obstructing the access for others to the
authentic contents of our agitational writing and the revolutionary new of the
SPK and the Patients’ Front.
By omitting the preface of Jean-Paul Sartre, they, and above all their preface
and postface writers, suppress the fact that Sartre not only called on the SPK
to continue, but moreover, in his preface, in clear and unambiguous terms,
awarded it an equally revolutionary tradition and a modern philosophical
stringency (signifier/signified).
There are therefore not only legal, but also content-related and political
reasons that prohibit a new edition of the book published by Édition Champ
Libre, also and above all in the interest of the patients’ class –
and especially because the publishers Éditions Météores and Édition Entremonde
show itself to be so ignorant as to allow such patients-hostile authors as
Florent Gabarron-Garcia and Quentin Dubois to write the preface and postface.
These are authors who, because of their professional hostility to illness,
their class interest, perceive the SPK contents exclusively through their
medically determined psychiatry-psychoanalysis-glasses and thus falsify the SPK
– to the detriment and harm of the patients’ class. This must be countered.
We therefore call on you to do the following:
Cease and desist from publishing a French-language edition of “SPK – Aus der
Krankheit eine Waffe machen”.
In order to end the matter amicably from a
legal point of view, we expect you to submit a corresponding cease-and-desist
declaration.
Deletion of the announcement of the publication on your website and all other
advertising measures.
Otherwise, we reserve the right to take further legal action.
